End User License Agreement

One person may use a Rayscaper license forever, on up to 3 computers at a time, and gets one year of updates and support.
1. Agreement and definitions
This End User License Agreement (“Agreement”) is between Thomas Loockx, Houtduifweg 8, 3140 Keerbergen, Belgium (“we”, “us”) and you, the individual who installs or uses Rayscaper (“you”). If you accept this Agreement on behalf of a company, the company is bound and you confirm you may bind it. By installing, activating or using the Software you accept this Agreement. If you don’t accept it, don’t install or use the Software.
- Software: the Rayscaper SketchUp extension and the standalone Rayscaper application, in object code, with their documentation and any Updates you receive.
- License: a paid license key or license file that activates the Software.
- Licensed User: the one named natural person to whom a License is assigned.
- Seat: one activation of the Software on one computer.
- Updates: new versions, fixes and improvements of the Software that we release.
- Support Period: the 12 months from the date of purchase.
- Free Version: the Software used without a License.
2. License grant
When you pay for a License, we grant you a perpetual, worldwide, non-exclusive, non-transferable license to install and use the Software, for commercial and non-commercial purposes, on these terms:
- One user. Each License is for one Licensed User. Only that person may use the Software under it. Two people may not share a License, not even at different times or on different computers. A team of five people needs five Licenses.
- Three Seats. The Licensed User may activate the Software on up to 3 computers at the same time, for example a desktop, a laptop and a home computer. The Licensed User may use all 3 Seats at the same time.
- Moving a Seat. To use the Software on another computer when all 3 Seats are in use, release a Seat first, through the license dialog or your account with our reseller.
- Perpetual. The License doesn’t expire. You may keep using every version of the Software released before the end of your Support Period, for as long as you want, also after the Support Period ends.
- Reassignment by a company. A company that bought a License may reassign it to another employee once the previous Licensed User has stopped using the Software and released all Seats, but not more than once every 90 days.
- Volume. The number of Licenses you bought is the number of Licensed Users you may have. Each of them gets 3 Seats.
3. Free Version
You may install and use the Free Version without a License, on any number of computers, for personal, educational and evaluation purposes only. Renders made with the Free Version carry a Rayscaper watermark. You may not remove, hide or crop the watermark, and you may not use those renders commercially: not for paid work, not for clients, and not to market a product or service. Sections 4, 7 and 8 apply to the Free Version too; Sections 2, 5 and 6 don’t.
4. Restrictions
Except where the law expressly allows it despite this limitation, you may not:
- share, lend, rent, sell, sublicense or otherwise give a License or the Software to anyone else;
- publish your license file or key, or let more than one person use it;
- remove, disable or get around the license check, the Seat limit or the watermark;
- reverse engineer, decompile or disassemble the Software, or modify it or make derivative works of it;
- remove copyright, trademark or other notices from the Software;
- use the Software to build a competing product, or to train a machine-learning model that renders like Rayscaper.
Renders you make with a License are yours. You may use them for any purpose, including commercial work, without crediting Rayscaper.
5. Updates and support
During the Support Period, you get:
- every Update we release, at no extra cost;
- support by email at [email protected] for installing, activating and using the Software. We answer as soon as reasonably possible. We don’t promise a fix or a workaround for every problem, and we don’t support third-party extensions, hardware or drivers.
After the Support Period, the License stays valid. You keep using the last version released during your Support Period, and every earlier version. Later versions need a new Support Period, which you can buy as an upgrade at the price we offer at that time. We may still answer questions about licensing and activation after the Support Period.
We decide what goes into an Update and when we release it. We don’t promise that the Software will keep working with future versions of SketchUp, Windows, macOS or GPU drivers.
6. Fees and refunds
A License is a one-time payment. There is no subscription and no recurring fee. Licenses are sold through our reseller SketchUcation, whose terms of sale also apply to the purchase; this Agreement governs your use of the Software.
If the Software isn’t right for you, email [email protected] within 14 days of purchase for a full refund. When we refund you, the License ends and you must release its Seats and stop using the Software under it. This doesn’t limit any right of withdrawal you have under the consumer law of your country.
7. Ownership, third-party components and online services
- Ownership. The Software is licensed, not sold. We and our licensors keep all rights, title and interest in the Software, including all intellectual property rights. Rayscaper is our trademark.
- Open-source components. The Software includes third-party components, such as the Cycles renderer, under their own open-source licenses. Those licenses are listed with the Software and take precedence over this Agreement for those components.
- Online assets. The asset library downloads materials, textures and HDRIs from online sources such as Poly Haven and our own material library. Each asset comes under its source’s license (Poly Haven’s assets are CC0). We may change or remove online assets and services at any time.
- Data. The Software sends anonymous usage statistics and crash reports to help us improve it, and checks your License with our reseller. See our privacy policy for what we collect and how to opt out. Scenes and renders stay on your computer unless you share them, for example with an AI agent you connect to the Software.
8. Warranty, liability and termination
- No warranty. To the extent the law allows, the Software is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that it is free of errors or runs without interruption. Try the Free Version before you buy.
- Limitation of liability. To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost profits, data or business, even if we were told they were possible. Our total liability under this Agreement is limited to the amount you paid for the License in question. Nothing in this Agreement limits liability for intent, gross negligence, death or personal injury, or any liability that the law doesn’t allow to be limited.
- Termination. This Agreement ends automatically if you break it and don’t remedy the breach within 14 days of our notice. You may end it at any time by uninstalling the Software. When it ends, you must stop using the Software and remove it from your computers. Sections 4, 7 and 8 survive.
- Changes. We may change this Agreement for future versions of the Software. A version you already received stays under the Agreement it came with.
- Governing law. This Agreement is governed by Belgian law, without regard to its conflict-of-law rules. The competent courts of Belgium have exclusive jurisdiction, unless the consumer law of your country gives you the right to go to your local court.
- Entire agreement. This Agreement is the whole agreement about the Software. If a provision is unenforceable, the rest stays in force.
